Please read these Terms and Conditions ("Terms") carefully before using The Bottle Square website located at www.thebottlesquare.com ("the Site") or placing any order. By accessing or using our Site, you agree to be bound by these Terms. If you do not agree to all of these Terms, please do not use the Site.

1. Age Verification & Legal Drinking Age

THE BOTTLE SQUARE SELLS ALCOHOLIC BEVERAGES. BY USING THIS SITE, YOU REPRESENT AND WARRANT THAT YOU ARE AT LEAST 21 YEARS OF AGE. We strictly prohibit the sale, purchase, or delivery of alcohol to anyone under the age of 21.

By placing an order, you confirm that:

• You are at least 21 years of age.

• The person receiving delivery is at least 21 years of age.

• You will not purchase alcohol on behalf of, or for the purpose of providing it to, any person under the legal drinking age.

A valid government-issued photo ID will be required upon delivery to verify age. Failure to provide valid identification will result in refusal of delivery. Any returned shipment and related refund will be handled according to our Return and Refund Policy. The Bottle Square reserves the right to cancel any order if we suspect the purchaser or recipient does not meet the minimum age requirement.

2. Eligibility & Account Registration

To purchase from The Bottle Square, you must:

• Be 21 years of age or older.

• Reside in a U.S. state where we are legally authorized to ship or deliver alcohol.

• Provide accurate, current, and complete registration and billing information.

• Maintain the security of your account password and accept responsibility for all activity under your account.

We reserve the right to refuse service, terminate accounts, or cancel orders at our discretion, including if we believe the information you have provided is inaccurate, fraudulent, or violates these Terms.

3. Products & Availability

The Bottle Square offers a curated selection of rare, fine, and premium spirits from around the world. All products are subject to availability. We reserve the right to limit quantities, discontinue products, and modify product listings at any time without notice.

Product descriptions, images, and details are provided for informational purposes. While we make every effort to ensure accuracy, we do not warrant that product descriptions, pricing, or other content on this Site is error-free, complete, or current. If a product is listed at an incorrect price due to a typographical error, we reserve the right to cancel any orders placed at the incorrect price.

Vintage year, label design, and packaging may vary from the images displayed on our Site.

4. Pricing & Payment

4.1 Pricing

All prices are listed in U.S. dollars. Prices are subject to change at any time without notice. Applicable taxes and shipping fees will be calculated and displayed at checkout prior to finalizing your order.

4.2 Taxes

You are responsible for all applicable federal, state, and local taxes associated with your purchase. Taxes are calculated based on your shipping address and are collected in accordance with applicable law.

4.3 Payment Methods

We accept major credit and debit cards including Visa, Mastercard, American Express, and Discover, as well as other payment methods made available at checkout. By submitting payment information, you authorize The Bottle Square to charge the applicable amount to your selected payment method.

4.4 Fraud Prevention

The Bottle Square reserves the right to refuse, cancel, or hold any order that we suspect to be fraudulent or in violation of these Terms. If your order is cancelled following a charge to your payment method, we will issue a full refund.

5. Shipping & Delivery

5.1 Shipping Restrictions

Due to state and local alcohol regulations, we are only able to ship or deliver to states and jurisdictions where such delivery is legally permitted. It is the customer's responsibility to confirm that receiving an alcohol shipment is legal in their jurisdiction before placing an order. We do not ship to P.O. Boxes or APO/FPO addresses.

5.2 Delivery Requirements

All alcohol deliveries require the signature of a person who is at least 21 years old and able to present valid government-issued photo identification.

If no eligible adult is available, valid identification is not presented, delivery is refused, an incorrect address was provided, or the carrier’s delivery attempts are missed, the shipment may be returned to us.

Returned shipments will be handled according to our Return and Refund Policy. Original shipping charges are non-refundable, and restocking, return-shipping, address-correction, and other applicable fees may be deducted from any refund. If an order received free or discounted shipping, the actual outbound shipping and handling cost, up to $40, may also be deducted.

5.3 Shipping Times & Carriers

Shipping and delivery estimates are approximate and are not guaranteed. The Bottle Square is not responsible for delays caused by carriers, severe weather, service interruptions, natural disasters, government action, or other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate delivery address and ensuring that an eligible adult is available to accept the shipment.

5.4 Damaged Shipments

Claims involving a significantly damaged product, incorrect product, or missing item must be reported to info@thebottlesquare.com within three business days of delivery.

The customer must provide the order number, a description of the issue, and clear photographs of the affected product, shipping box, shipping label, interior packaging, and all items received.

The customer must retain the product and all packaging materials until the claim has been resolved. Damaged or broken products must not be returned or discarded unless The Bottle Square provides specific instructions.

Minor cosmetic issues including small label scuffs, minor dents or creases in manufacturer packaging, light box wear, and manufacturer packaging variations do not constitute significant damage.

Eligible claims will be handled according to our Return and Refund Policy.

6. Returns & Refunds

Due to the nature of alcoholic beverages and applicable regulations, all sales are final. We do not accept returns or exchanges because a customer changed their mind, ordered the wrong product, no longer wants the product, or did not like its taste.

Exceptions may apply when:

• A product arrives significantly damaged
• The customer receives an incorrect product
• An item is missing from the shipment
• The product received materially differs from the product ordered

All claims must be submitted within three business days of delivery and comply with the documentation requirements in our Return and Refund Policy.

For an approved claim, The Bottle Square will offer a replacement when the same product is available or issue a refund to the original payment method for the affected item.

Approved refunds are generally processed within 5–10 business days. The time required for the credit to appear may vary by bank or payment provider.

Optional Shipping Protection may provide additional coverage for qualifying packages lost while in transit. Purchasing or declining Shipping Protection does not change the procedure for reporting significantly damaged, incorrect, or missing products.

7. Responsible Service & Use

The Bottle Square is committed to responsible alcohol service. We encourage all customers to drink responsibly. We reserve the right to refuse service to any customer at our sole discretion, including situations in which we believe a purchase may be associated with irresponsible or harmful use of alcohol.

8. Intellectual Property

All content on this Site, including but not limited to text, images, logos, graphics, product descriptions, and the overall design, is the exclusive property of The Bottle Square or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, display, modify, create derivative works from, or otherwise exploit any content on this Site without our prior written consent. The Bottle Square name, logo, and taglines are trademarks of The Bottle Square. Unauthorized use is strictly prohibited.

9. User Conduct

By using this Site, you agree that you will not:

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE BOTTLE SQUARE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You waive any right to participate in a class action lawsuit or class-wide arbitration.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.

16. Severability & Entire Agreement
